Best Derby Moment: O.J. Gets Booted

My favorite Kentucky Derby moment was not watching Calvin Borel masterfully guide Street Sense along the rail to set up their victory. Nor was it seeing Queen Elizabeth II, herself an avid horse woman, enjoying the race from the Turf Club railing.

It wasn’t even listening to the pre-race tribute given last year’s fallen champion Barbaro and his wondrously empathetic owners, Roy and Gretchen Jackson.

While all offered something memorable in their own right, nothing topped hearing that O.J. Simpson — who I’ve seen in nasty action myself at Churchill Downs — was unceremoniously given the boot from a downtown Louisville steakhouse on Derby Eve.

For me, the hero of the 133rd Kentucky Derby is restaurateur Jeff Ruby, owner of Jeff Ruby’s Louisville.

“I didn’t want that experience in my restaurant,” Ruby told a Louisville reporter earlier this week.

He said seeing the former NFL great — who was found innocent in 1995 of killing his ex-wife, Nicole Brown Simpson, and Ron Goldman, but was found liable in a civil trial — “makes me sick to my stomach.

“I didn’t want to serve him because of my convictions of what he’s done to those families. The way he continues to torture the lives of those families … with his behavior, attitude and conduct.”

And last year on the Churchill Downs backside — where Simpson has shown up the past four races — I got to witness some of that attitude and conduct up close.

Seeing Simpson one morning before the 2006 race, I approached him — and shame on me for doing so — to find out what he was up to.

In the late 1970s, I’d interviewed him as his NFL career was winding down and I’d done another story with him in the 1980s during one of his many trips to Miami, where I was a columnist I hadn’t talked to him since.

On this May day a year ago — as the aging, blond woman he was with stepped up onto a wooden viewing stand to watch the morning workouts — he talked about how he was picking Lawyer Ron in the Derby:

“I love lawyers, I know all about them. If there was a Lawyer Johnnie, Lord knows, I’d put my house on him,” he said in chuckling reference to Johnnie Cochran, the attorney who had helped him avoid murder charges.

Then Simpson started talking about the Derby party scene, which he said he was immersing himself in as much as possible:

“You got better parties here than you do in Miami at the MTV Awards. It’s the No. 1 event of the year. The hip-hop, movie and horse culture are all here. It comes down to Kentucky hospitality. I feel totally comfortable and everybody’s great.”

Simpson was making me sick to my stomach and finally I just turned away, leaving him talk to a fan.

Moments later, when he was ready to leave, Simpson looked up at the woman and said flatly, “Let’s go.”

Enjoying herself as she watched the horses, she said, “Just a minute, I want to….”

She never finished because Simpson commanded, “Get down here…now!”

The words were cold and hard. He glared at her and the animation instantly drained from her face. She came down without a word.

And then — in what was a subtle, but telling move — he reached over as if to take her hand, but instead clasped onto her wrist. And giving it a slight twist to make sure the torque was turned up, he walked her off in the direction he wanted to go.

Some six months later, after an offer to him for $3.5 million, he attempted to publish his book — “O.J. Simpson: If I Did It, Here’s How It Happened,” — and do a two part TV interview, as well. Both projects were eventually cancelled over public outcry.

This Derby, O.J. was back in Louisville, laughing, telling stories, making the rounds. During race week, prices are jacked up considerably but that doesn’t seem to bother Simpson, who has not paid a cent of the $33.5 million he owes the Goldman family after being found “criminally liable” in a civil suit.

Finally, though, somebody here took a stand.

And the thing is, Ruby — who has a string of restaurants in Cincinnati, Belterra, Ind. and Louisville — always has been one to cater to big-name athletes.

In fact, before the 1994 murders, he served Simpson several times in his Cincinnati restaurant and used to have a picture of the two of them together on his wall. After the murders, Ruby said he took down the picture.

That sets the stage for last Friday night about 10:30 when Simpson showed up at Ruby’s W. Main Street restaurant with about a dozen people in his party.

Soon after, Ruby — in the account he gave the Louisville writer — said he informed Simpson, “I am not serving you.”

When Simpson didn’t respond, Ruby told him again and then left the room.

“This was the only thing I could do for the victims’ families,” said Ruby.

He said Simpson then approached him, told him he understood and then left the restaurant without incident.

“It was the first time since 1994 he has ever shown any class,” Ruby said. “He showed it that night in the restaurant.”

Ruby said some 50 people in the private room where Simpson had been seated “stood up and applauded me” when Simpson left. Since then Ruby said he’s gotten over 100 e-mails supporting his move.

But Simpson’s attorney, Yale Galanter, told the Associated Press:

“He screwed with the wrong guy, he really did.”

Galanter said he intends to pursue the matter and possibly go after the restaurant’s liquor license. He said Ruby’s move was done because of race.

On that, the guy is right.

But not the black race or the white race as he contends.

No, in my book, this was done for the human race to which Simpson is an affront.

And it was especially good to see Simpson getting some of that same Derby hospitality I saw him give that woman he was with last year.

With a verbal twist of the wrist, somebody finally told O.J.:

“Let’s go.”

Dan, you said “The facts are the same irregardless of race.” I’m glad you said that. The fact is, O.J. wasn’t convicted in the murders. If I buy what you are selling about Ruby not serving O.J. because he believed O.J. was guilty, then that means that Ruby discriminated against O.J. based on his own belief about O.J. Is that right? So now we can just go around and discriminate against people? C’mon now. Just because we don’t like someone does that mean we should use the power we have to keep that person from getting something? Ruby had the power to keep O.J. from something based on a belief, not a fact. Smells like racism to me.

OJ was asked to leave because the owner of the restaurant could not serve him with a clear concience because he believed that OJ murdered two innocent people. And the facts of the case are such that almost anyone with a rational frame-of-mind would agree that OJ committed the crimes. The facts are the same irregardless of race.

Lt. Dan: It is about race when it comes to OJ. The only people who don’t think it’s about race are white people. OJ was found guilty before he ever stepped into the courtroom. He was considered to be a successful black man who was accused of killing a white woman and white people did not like that. Media coverage during the time of the trial proved my point. I am not defending OJ, but I know racism when I see it. We can talk all day and night about the evidence that was shown in the court. Now, I have a question for you - was OJ convicted? So why did Ruby shun him? Jeff Ruby didn’t want OJ in his restaurant because he knew those white customers would complain. Ruby wasn’t trying to honor the families. He wanted to make himself look good in front of those white customers. And how does he do that? By booting out the one person they can’t stand. Ruby wanted publicity and he got it.

Yeahwritekelli: The issue really has nothing to do with race. The evidence against OJ was overwhelming. Anyone other than OJ would have been convicted. It is amazing that he got away with it. The defense fooled the jurors into believing that the LAPD planted the evidence. The possibility that the LAPD could have planted the evidence as it was presented in the trial was astronomical. Just consider one question. If the LAPD set OJ up, how did they get his blood without his knowledge?

The only reason Jeff Ruby turned O.J. away is because O.J. was a black man accused of killing a white woman. We all know that white America does not like that combination. We don’t know what happened to Nicole Brown and Ron Goldman, but what we do know is that O.J. was not convicted of their murders. It is unfortunate that in America, the black man is always guilty even after the evidence shows he’s not. I’m sure O.J. had that same arrogant and demanding attitude - that he displayed with the blonde a year ago - that he had when he posed for the picture that once decorated Ruby’s walls. Before the murders, O.J. had a bad reputation when it came to women. Why didn’t Ruby refuse to serve O.J. during those times? Ruby is not to be congratulated. He’s just a business owner who fell under the pressure of his white customers who had their minds made up before O.J.’s trial - guilty.

Good for Jeff Ruby (his restaurants are great BTW). OJ is a liar, murderer and overall piece of crap for how he has since tormented those poor people who lost their loved ones. I hope other proprietors take a tip from Mr. Ruby and put an end to OJ’s opulent lifestyle. It’s about time someone held him responsible for what he did. …And “not guilty” IS entirely different from “innocent”. Shame on those who uphold him just BECAUSE he’s black. Maybe so many communities have crime problems for just that reason. I wouldn’t want Robert Blake served either, just for the record. Right is right and wrong is wrong. Ultimately, we will all have to answer to God so nobody really gets away with anything…some people just have to pay for their crimes sooner while others meet their judgment later (and probably much more severely).

Why does everyone keep saying he was found “not guilty”? That is not the same as being found “innocent”. But more importantly, he was found guilty in the civil proceeding.

Bottm line is NO ONE but O.J. and the Victims REALLY know what happened. What is overwhelmingly obvious is that O.J. was tried twice for the same crime (double jeopardy anyone?)… One trial to the crapper to appease the Black Community (Who had publicly threatend a repeat of the Rodney King riots) and another one to the crapper to appease White America making them feel some form of justice was served. The whole thing was pathetic and America, black & white both, are to blame.

Mr. Simpson was found not guilty in the greatest injustice in American history. The facts clearly pointed to his guilt, but the jurors were duped by a strong defense team. Can anyone really believe that the LAPD could have done everything that the defense contended. They would have had to obtain OJ’s blood, sprikled it on his socks and placed those socks in his bedroom, dripped his blood all over the crime scene, found his unique pair of shoes and made fake footprints at the crime scene, made cuts on OJ’s fingers without him knowing, dropped a bloody glove behind his house etc., etc. etc. With that in mind does anyone still believe that OJ did not commit the crimes?

Mr. Simpson has the right to eat wherever he pleases. The man was found not guilty. It isn’t if we believe he was guilty or not, he was found innocent…end of story. Let’s get on with life. Let the dead bury the dead. Enough hurt has gone around..let’s think of the Simpson children..after all they have gone through emotional setbacks already.

For decades their have been many people that have gotten away with unspeakable things is this the only person to get away with a crime no!! the President is sending our young men and women to die for OIL know that’s a real murderer. O.J might have gotten two who knows but Bush has gotten thousands lets put our voices into stopping a real mass murder.

Who gave the right for you to be Judge & Jury. weather you think he is Guilty or not, He is still part of the Human Race and deserves the same rights as the next guy. I am not opinionated but I see you are. I was arrested and found Guilty of something I did not do and (it’s called Justice) In a real court you are guilty until you prove yourself to be innocent.

Why is it in this country if a business owner who has a right to his opinion chooses to exercise his right to not serve someone people freakout and play the racecard if it is a black man.If he refuses to serve a white murderer someday no one will care. I think that it was a racist move. O.J. was aquitted. Who made this man judge? You would let Lt. Wm. Calley eat there, and Pres. Nixon if he were alive. One of these men was convicted of his crimes, the other resigned because of his crime. Would they be refused service?

Any business has the right to refuse service to anyone. Basic principle of doing business.I applaud Mr.Ruby. He has a standard that he adheres to. For those that think he is a racist, remember that he had pictures of Orenthal James and himself hanging in the restaurant at one time. He made a decision that any business is ENTITLED to make. I DO NOT WANT YOU IN MY BUSINESS! Is Mr. Ruby not entitled to his opinion and rights? A court said Orenthal James he was “Not Guilty”.It did not say that his life was expected to be the same as before the murders, the murders that he swore to”spend every last dime trying to find the killers”.As he jet sets around partying and trying to be cool and accepted by the “beautiful people”, perhaps he should keep in mind that he has a “promise” to keep and a $33 million dollar settlement to square with his “victims” families. To the African-American community that so vehemently supports him I can only say shame on you. You know he is guilty but because he is black, you can’t see the truth. What’s your take on the disguise and the $10,000. in cash he was caught with? College prank? Just fooling around? Early Halloween? If you are seeing this man as a hero of your community, I have little hope for you. Right is right, wrong is wrong. Your community was wronged for WAY too many years. However, this is not the battle to choose as an example of how far you have come. This showed how little you think of the bigger picture of justice.

He was guilty of murder and he knows it and is very smudge about it. His book he wrote proves it. It is sicking. I do not care if 12 people on jury found him not guilty..DNA sealed his guilt for all to see. Just shows you he had better lawyers than the prosectors is all. Sometimes people get lucky..he sure did.

Hats Off to Ruby! This country is run by injustice. Ruby- Time to Run for president. You now have the popular vote. It was good to see the Queen put Bush in his place too! Bush an OJ have things in common. Think about that!

Hats off to Mr Ruby. If I’m ever in Louisville, I’ll be sure to patronize his restaurant,provided of course,that the PC crowd hasn’t run him out of business. I sure hope the community rallies around him and makes sure his restaurant thrives.

My question— How can he even afford that joint? Doesn’t he owe the Brown/Goldman’s over 33 million? And are we really surprised that he or his “lawyer” played the race card? It’s pretty much worked since ‘94. Gotta stick with what works!

Great article! Kudos to Mr. Ruby and Mr. Archdeacon! Mr. Ruby’s behavior, and this article, will hopefull help others have the courage to stand up for what they believe is right. I know it will certainly help me maintain my integrity, and be spontaneous in the face of saving face or fear of conflict and consequences. Thank you for this article!
