Montgomery County Commissioner Debbie Lieberman was treated the same as any other first time drunken driving offender who is eligible for Vandalia Municipal Court's diversion program, Judge Cindy Heck said Thursday.
"Everyone who qualifies is offered it," Heck said. "It's very fairly applied."

The court began the program several years ago and it is grandfathered into current Ohio law, Heck said. She has jurisdiction in Vandalia, Englewood, Clayton, Union, Butler Twp. and Harrison Twp.
Lieberman was placed into the diversion program Tuesday after being charged by the Ohio Highway Patrol early Saturday with operating a vehicle under the influence of alcohol and a lane violation on Interstate 70 near Englewood.
She was taken to the patrol post and later released to her husband, attorney Dennis Lieberman, a member of the Montgomery County Board of Elections and former chairman of the county Democratic Party.
Heck is the wife of Montgomery County Prosecutor Mathias Heck. The Hecks are also Democrats.
Lieberman's record includes several speeding tickets but no accidents, which would have made her ineligible for the diversion program. Heck said it is only available to first-time offenders who are over age 21.
"I was treated the way she treats every first-time offender that gets diversion," said Lieberman. "I'm not being treated any differently."
If there is no subsequent offense, and Lieberman completes a three-day alcohol program, the driving while intoxicated charge will be dismissed, Heck said.
If there is another offense, Heck said the original charge is imposed, along with a six-month license suspension, in addition to the penalty for the new offense.
Dayton Municipal Court does not offer the program, said Mark Owens, court clerk and the current Democratic Party chairman. He said he learned of Lieberman's arrest Thursday afternoon.
"I think obviously she made a mistake. I think she has admitted she made a mistake," he said. "It was out of character for her."
Lieberman, who is completing her first term on the commission, is running in the March 4 Democratic primary against Mark Anthony Newberry. There is no Republican opposition.
Lieberman said she had hoped the matter would not become public: "After I went to diversion and they said it was dropped, I said that was a blessing."

I think the “punishment” for Debbie Lieberman is laughable. This was political home cooking like this community has not seen in a VERY long time. During election campaigns candidates want us to believe that they are just like us….well when you step out of line Commissioner take the very same medicine and truly stand up and show you are truly one of us!!!

Huckabee could be featured in an ad while the jingle, “I wanna be, I wanna be like Mike” plays in the background.

And Debbie Lieberman would have to be the spokeswoman for an anti-promiscuity campaign, “You can get me drunk, ride me, I’ll blow ya, we can even include handcuffs, but I’ll never ever do it again.”
Though it’s debatable whether our politicians would make good celebrities, it’s apparent that both are a part of an “in-group” that entitles them to privilege and special treatment that is not extended to everyone else. But don’t be mistaken, there is no longer ONE all-inclusive “in-group.” There are many “in-groups” that have different agendas.
Though the “Lieberman/Heck in-group” may save Debbie from a harsh punishment many “in-groups” have taken shots at both families. There is an “in-group” that made the Hatch-Act violation of Matt Heck public knowledge. Just ask the Mike Turner “in-group” how to knock-off your potential opposition. There is an “in-group” that prevented Mr. Lieberman from becoming the state chair. Ask the Chris Redfern “in-group.”
Believe me; those of you who think the Heck’s and Lieberman’s are a part of an elite “in-group” are sorely mistaken. Both families have been involved in local politics for well over 30 years and have yet to be voted in to any office of significance. Trust-they do not have the knowledge, power, or ability of the “Bush-Rove in-group” that discounted votes in Florida. Thus, if you have an issue with the Heck-Lieberman cronyism-Vote Them Out!!!
I’m ecstatic about the type of celebrity Debbie Lieberman has become. She has received more notoriety for her biggest mistake than any good that she did as a County Commissioner. Maybe, that’s because, as cited by the Dayton Daily News last summer, she hasn’t done anything of significance since she has been in office. That’s why YOU-THE VOTER, are a part of a very powerful “in-group.” An “in-group” that deserves much better representation. An “in-group” that should continue to debate the role of the Politician.
Do you want them to be public servants or celebrities? Yes, it’s debatable if the line between politician and celebrity is as thin as I’ve suggested -but it’s clear that both know how to party like ROCK STARS.

There is a simple answer to all of this and thankfully it has been put in our hands. There is an election coming up. Simply vote her out of office if you feel she is unfit. When she loses the election the drunk driving issue will come up again causing her more embarassment. Frankly the greater punishment to her would be losing her position as a commissioner. The DDN needs to police this board to keep improper comments from being aired like the one from Beer Me… How does a DUI equate to being sexually permiscuous… Let’s stick to the point drop the name calling and be adults about this. She got off lightly. I was working for cheap wages while going to school to get CDL to drive for a living. My insurance lapsed by 2 weeks. Beavercreek pulled me over on my way to work. Lost my license for a year just got them back in October. It was big financial blow. It is all about the money.

Aside from the obvious favoritism, the other concern for all county residents is the blatant lying and attempts to cover-up her wrong (the tape and “better come out with it before they do”). Is this the kind of leadership we need/want? Obviously since it seems the people keep voting them in. If this city/county has any values and morals left its time to show them at election time.

honest to god this is crap. why did mr. lieberman come forward and say there was a call made to the judge to let her know “this was coming”? how ridiculous! she only got $500.00 in court costs (when my friend got $1500.00), 3 day diversion, and no suspension . i have known everyone, from every diffent walk of life….rich…black…white…..poor…middle class…they get a dui, they get their license jerked, jail time or wsu. she should have at least got some suspension.

I know I have seen the Heck family and Liberman family together before at public events. They appeared to have a friend relationship, with one another. Maybe Judge Heck should have excused her self as with her husband on this case, due to a personal relationship. Amazing!!! When my child got a DUI, I was informed it could never be removed. They have to do jail time and the 3 day treatment program. This woman could have killed someone just as well and she is going to get her hands slapped and it is done. No special treatment???? She is very much getting special treatment. I am not saying she should lose her job or anything like that, but the punishment should be the same across the board. If her offence drops off in a year, why shouldn’t my child?

All opinions aside, I have seen worse outcomes than simply getting pulled over here in Englewood/Vandalia and surrounding areas that have received the same punishment. As long as it is your first, overnight in jail and a 3-day program, in addition to all the court costs and things, is consistent to what I’ve have seen. Not saying it is the right or wrong punishment, but she was given the same treatment as the 3 or 4 people I know in this area.

The facts of the matter are: 1. Ohio law prohibits diversion programs for DUI’s 2. the law requires a 6 month ALS suspension for a .13 test 3. there are many people who have multiple DUI diversions through Vandalia Court—it’s not really a one time thing 4. no other court in Ohio has DUI Diversion because they are prohibited 5. the DDN will rarely speak ill of the Heck’s. (Prosecutor Matt and Judge Cynthia). Hecks have too much authority and too many conflicts of interest for one family.

Sense has it right. You ever wonder why drinking & driving is never a problem in the downtown areas of most every city in America? It’s because cities that attract residents have light rail systems and plenty of taxi cabs. The suburbs have none of that, and far fewer crimes taking place after midnight. Cops have to give out tickets, so your their target. They’d rather have you stay home and watch TV, anyway. What a great place to live, huh?

I have had DUI”S/OVI’s. The fact is I am glad that I didn’t kill anybody. No one is perfect. I’m sure Judge Heck is going by the book. Politics could be involved but I will remind you that if Debbie has an alcohol abuse problem, I am sure drinking is hurting her spiritually. It may not come out in DUI’s but in other parts of her life. So I don’t believe in an eye for an eye.I found that being angry with the system doesn’t work. I learned to “love god, love the person, and hate the sin”.

Humans are social creatures by nature. We have always needed to get together with others to socialize. It’s been that way since the beginning of time. It has become a problem in our modern society when people need to get in their cars to drive home. Until cities offer alternate forms of transportation, the problem will continue. As a result people will always drive drunk to some degree. You can only offer them a safer form of transportation home.

I think the question of whether or not she received preferential treatment is irrelevant because we all know that the judicial system is far from fair. The true issue is if you voters will remember this on Election Day? To anyone who thinks that our elected officials should not be held to higher standard-you are clueless. Elected officials are supposed to be leaders for the children in our community. Elected officials are supposed to be the “moral compass” for the citizenry. Instead, they cheat on their wives and lie about it; solicit sex in public restrooms; and now drive while wasted. Dems such as Gary Staiger should be ashamed to defend Miss Lieberman’s actions.

OVI’s are serious, but our law enforcement officers and prosectors, and judges treat everyone different depending on who you are. Any common person would have been sent straight to jail and lost their license for a period of time; not to mention they would have a convition on their record, unlike Lieberman. The people of authority do what they want.

As mentioned, I got busted in Fairborn. Up until then, I had a perfect record - no accidents and no other convictions (with the exception of a few speeding tickets).
I didn’t blow. Got a lawyer. Lost license for 6 months. No jail, but attended 3-day program at WSU. Diversion program was not offered to me. Went to court 4 months later. Plead guilty to a lesser charge (physical control while under the influence). 3-months probation. There’s no doubt in my mind there was politics involved.

Yes, and stay away from Centerville & Washington Twp. After midnight the Sheriff Dept. prowls and prowls for DUI’s. I was messing with my radio one night and swerved a little once, and had one follow me for 3 miles only to pull me over right in my own driveway. I had to do the stupid human trick right in my front yard. Is that prevention or harassment? By the way, I wasn’t drinking but my friend had been. The cops smelled him and made me get out. I was quickly released and apologized to.

It’s all about MONEY!!!! Young people are suppose to make mistakes but now they are branded forever, unless you are a neighbor to the Heck’s, then your OVI gets removed, unlike everyone else. She is old enough that she should get sentenced/punished more so than a 18 year old. Instead she gets a better deal while pleading guilty.

I don’t think most people understand how much power prosecuters have. They can make you or break you in this county. In many instances they have more power than a Judge. You are just a number and a “win” for them. So, if you have a well known name like Lieberman you will probably skate by, but if you are Tom Smith you are sentenced for life.

You’ve got that right, bspolitics. Not only that, but now, they have offices in most high schools, and drag the kids into court for practical jokes we all did in the past. For instance, steal the victory bell from you high school rival, and your up on charges. They say they want to teach the kid a lesson, but we all know, they really want those excessive court costs. Money is the root of all evil. Including law enforcement and the court system.

Really? Why wasn’t it offered to me? I took the 3-day class and all of that. But now I have a conviction of “Physical Control While Under the Influence” on my record. It’s not a DUI, but it’s still an M1 misdemeanor. :(

We’ve gone from just the neighborhood drunk getting a DUI, to everyone I know now has a DUI. Sheriffs & Troopers are DUI crazy in Montgomery County. They’re driving all over the place looking for any car that swerves. Meanwhile, the rapists, drug dealers and thieves go on without disruption. Bust a DUI and get $2000 revenue. Bust a rapists and get no money and more prison over-crowding. We know what they’re up to. I don’t think I want to give my tax money for that kind of abuse anymore

I was arrested for DUI a couple years ago in Fairborn. I had a perfectly clean record; it was my first offense, and I have never been in an accident. This was program was NOT offered to me. I eventually plead guilty to a lesser charge.

Well, maybe that is the difference in officers. I guess than she is lucky she did not get pulled over in Englewood. I know people that blew less than she did and was sent directly to jail. Maybe these people should find out who is on duty before they party.

I lived in OH for 30 years. Now live in AZ. Your DUI laws are very lax compared to most. 1st offense here in AZ, automatic loss of license for 1 year, 10 days in jail, $1500.00 fine AND you must have a breathalizer installed on your car. that is an additional $100.00 a month!!! Have DUI’s dropped since the new law went into effect, you bet they have!! This woman is a County Commisioner and she does not know better!!! She would be wearing pick underwear and hanging out with Sherrif Joe here in AZ

OSP did a great job! They did not provide any favortism to Lieberman. Many drunks get released to a spouse and/or responsible party after a DUI arrest.

I don’t think anyone hates the Lieberman’s. In fact I like them. The problem is she was treated differently than most. I know this for a fact. Most people would have been taken to jail and bonded out. Most people would have lost driving rights for a period time. Most people would have this on their record unless it was dropped to a lesser charge. She plead guilty and was treated special. That is the issue. Not whether she made a mistake and is sorry for it.

Debbie Lieberman’s penalty (3 days in jail — suspended upon completion of a weekend intervention program) seems to be average. However, the absence of any jail time and the no suspension of license seems a little lenient. Also, Diversion is a program offered by the Prosecutor’s Office (Matt Heck). The accused has the charges dropped. So, Lieberman will have no conviction, or plea to make, or perhaps even points on her license (?!?!?!?) Paris Hilton is jealous!

She lied.—I only had two glasses of wine She tried to cover it up.—I did not want it to become public. She got preferential treatment. Arrested at 3:00 on saturday; allowed to waltz into the court first thing on the tuesday (monday was a holiday) and get her slap on the wrist fromn a judge that is a political crony. What does this say about character? Married woman with kids closing up the bar and driving home drunk.

Ms Lieberman was drunk. She was driving, she put lives in danger. I know numerous people who have gotten DUI’s and have had less a blood alcohol content than she.

Ms. Lieberman should be tried in a far away, distant county. She’s too well connected in this county. Most people who get pulled over for DWI are held in the county jail until they are arraigned before a judge. Thus, Ms. Lieberman was already given the special treatment.
For you all people out there, who want the government to create all these laws and fix all your problems, real and perceived, take note, the people of privilege, do NOT have to abide by them.

They should’ve been lenient on her, the same way they should be lenient on everyone of us who is not habitual drinker. The real problem is the repeat and habitual offenders. The rest of us are not even buzzed at .08, and can safely drive without any impairments. It’s the stumbling drunks we need to get off the roads. Police don’t seem to have that discretion anymore. Since 2000, they seem to be looking hard for any offender they can find that is over .08 and writing as many tickets as possible.

give me a break. everyone with a good lawyer gets the same treatment as lieberman. that is the way it works, right or wrong.
doesn’t everyone know someone who has gotten a DUI. did you spend time ridiculing them on a blog?
What she did is wrong, but she’ll be punished more than most. for instance, people will write about it in local paper and let other people comment on it, even if they don’t know much about the DUI laws.

She just got caught up in all the same stuff we are all trying to deal with. There has been a huge jump in DUI & OMVI since MADD became such a large special interest group. They give money to the government to enforce drinking and driving. If law enforcement agencies don’t give out enough sitetations, MADD threatens to take away the money. Law enforcement should NOT be paid by special interest groups. Do you want special interests groups owning our police? They already own our elected officials.

Well, let’s see. She did not have to be bonded out like everyone else. She’s neighbors with the Heck’s. Her husband is a sitting Judge in Vandalia. And to top it off when she is done with the 3 days of rehab and keeps a good record for one year she won’t have a record at all, after pleading guilty. I wish I was part of that party. Your common folk would have a record and lose their license for a period of time.

a response to the person who said she could be a school bus driver, I’m not defending her but you should know that she can’t drive a school bus in ohio now. you don’t get 3 strikes and you also don’t get to blow a .08. all ohio CDL’s have a limit of .04 and a DUI will get you shown the gate in a hurry. but i do have a question for the JUDGE, Will the Comissioner get a set of those pretty orange PARTY PLATES for her car and have to be limited to one vehical like the regular drinkin folk?

The diversion program has been in place for many years. This was set up by judge Banaster not judge Heck. Judge heck offers this process to all that qualify. This way the violator must complete and pay for the alcohol treatment program. On a first offence without this program you pay your attorney $3000 to to get the violation down to reckless operation.

C’mon people. Does it really matter that a person who is caught in a DUI belongs to one party or another? People are human and make mistakes. This is not an anomoly for one party or the other. It’s all about politics….Sure she was eligible for the diversion program…BUT I have never seen someone’s case be disposed of in a matter of a few days….There’s your special treatment. She was wanting to keep a tight lid on it so know one would know about her arrest and that’s why it was disposed of so quickly. On the other hand…it’s good to see that the highway patrol didn’t give her any special treatment and they are out there getting intoxicated drivers off the road like she was.

Well I think I might have me two glasses of wine tonight and drive up to Vandalia. When the Highway Patrol eventually pulls me over and I blow a .131 on the scale. I will tell the Trooper to take me to see Municipal Court Judge Cindy Heck becuase I want one of those “Montgomery County Commissioner Debbie Lieberman Specials” so Judge Heck can call my wife to come pick me up and I keep my license in my wallet.

Not to excuse impaired driving, but who hasn’t done the same in their life? Just cause you drink doesn’t mean you’re alcoholic. Just cause you drive after drinking doesn’t mean you’re alcoholic. If that were the definition, at least 80% of us would be alcoholics. Anyone who spends any time in a bar or a restaurant drinking probably qualifies as impaired behind the wheel. The big problem is the chronic drunks with repeated DUI’s, not the average person. Leiberman should get equal treatment.

Same story, different name and day..Politicians (especially the Democratic Party in Montgomery co./Dayton) lay in bed together all the time. The big issue is the ethical and moral concerns I have for this so called leader who is expected to take care of our disperal of moneys, concerns, etc..First Heck and his ethical dilemma “asking for party donations” from employees and now this. No wonder the city and area populace is leaving in droves.

You can’t tell me she did not recieve special treatment. I personally know people who have got OVI charges in Vandalia and their case did not go AWAY as quickly as hers. She should have automatically lost her license on the spot, that is a law and a BMV automatic rule if you blow over the limit. They have an Automatic license suspension for anyone who blows over the limit,and she did not have to have any hearing or appeal process that the normal folk go through.

She blew a 0.131 with only 2 glasses of wine?! Beep! That’s a lie. And after a dinner, a meeting and reception, and trips to two bars? Beep! That’s a lie. Where are the witnesses as to how many drinks she really had? She needs to realize that she is putting people, including herself, at risk of death due to her problems with alcohol - not to mention leaving her sons without a mother. And what is it with Dayton voting her in as a City Commissioner? As a former Daytonian, I’m shocked!
