A 55-year-old Dayton man is accused of breaking into a woman’s apartment earlier this month and then stabbing a teenager who confronted him.

Charles Hutsell Miller was indicted Wednesday for burglary and two counts of felonious assault by a Montgomery County grand jury.

Miller went inside an unlocked apartment in the 300 block of North Smithville Road and began taking items and putting them inside his car while the resident was not home, according to a Dayton Municipal Court affidavit.

A maintenance man saw Miller and called the woman who lived there, who returned and alerted her neighbors.

“Miller attempted to flee after committing the burglary, but was confronted,” the affidavit stated.

Miller got into a fight with a 16-year-old who tried to prevent him from leaving and stabbed him multiple times, according to court records.

Miller also suffered stab wounds during the incident.

He will be arraigned on the charges Tuesday in Montgomery County Common Pleas Court. He has been held in the Montgomery County Jail since his July 16 arrest.
