Attorney: Rights violated for Miamisburg suspect shot by police after robbery

A Dayton teen facing several charges after he was wounded by police following a Miamisburg armed robbery that authorities say he was fleeing is scheduled to return to court today.

The attorney for Charles Vincent Ashford wants to suppress statements his client made to authorities after his arrest in connection with a Feb. 5 robbery of a Byers Road gas station, court records show.

Authorities interrogated Ashford, then 17, “without first obtaining a knowing, intelligent, and voluntary waiver of his Miranda rights,” according to the motion to suppress statements.

Authorities said Ashford, who is now 18 and being charged as an adult, claimed to be an FBI agent as he sought to escape the scene near the Ohio 725/Interstate 75 interchange before being shot in the arm by an off-duty Miami Twp. police officer.

Not guilty pleas have been entered for Ashford on 10 counts, which range from discharging a firearm over a public roadway, impersonating a peace officer and several armed robbery charges. The vast majority of counts in his July 20 indictment include firearm specifications.

Several law enforcement agencies responded to the scene near the Dayton Mall on the afternoon of Feb. 5. Authorities said Ashford was seeking to flee the armed robbery by attempting to car jack nearby motorists.

The police officer who wounded Ashford acted lawfully, a grand jury ruled. Ashford is being held in juvenile detention after a $500,000 bond was set.
