Dayton man pleads guilty to charge in death of man left near hospital

A Dayton man accused of leaving another Dayton man, later pronounced dead, at the entrance to a Miami County hospital pleaded guilty Thursday to felony tampering with evidence.

Virgil Corbin, 49, was indicted last year in a January 2017 incident in which Terry E. Sims, 59, was found at the Upper Valley Medical Center entrance north of Troy by a nurse going to the hospital. The death was caused by multiple drug intoxication by fentanyl analog, cocaine, ethanol and hydrocodone, an autopsy report by William Ginn, Miami County coroner, said.

As part of a plea deal, prosecutors will remain silent at sentencing except to recommend a maximum 24 months in prison for Corbin, if any prison time is ordered, defense lawyer Anthony Sullivan told Judge Jeannine Pratt. The charge is a third-degree felony, which carries a maximum possible sentence of three years in prison. Corbin also could receive community control.

Pratt accepted the guilty plea, ordered a presentence investigation and scheduled Corbin’s sentencing for July 3 in county Common Pleas Court. Sullivan asked for the presentence investigation to include a screening for Corbin’s possible participation in the MonDay rehabilitation program.

Corbin remains in the county jail in lieu of $15,000 bail.
