Union Twp. man accused of raping juvenile reaches plea deal with prosecutors

A Union Twp. man originally charged with felony rape and other offenses pleaded no contest Wednesday to one felony count of disseminating matter harmful to juveniles as part of a plea deal.

Miami County prosecutors said with the plea, they would dismiss indictments issued in 2016 by a county grand jury against William Durham, now 49. He was charged with two counts of rape, one count of gross sexual imposition and two counts of illegal use of a minor in nudity oriented matter.

Those charges alleged illegal activity with a person younger than 13. Durham had pleaded not guilty.

Assistant Prosecutor Jana Parker declined comment on the plea deal after Wednesday's hearing.

Durham was scheduled to go on trial next week in Common Pleas Court.

The new charge alleged that between Jan. 15 and Sept. 23, 2015, he provided to a 13-year-old material or performance that was obscene.

The charge carries a potential sentence of one year in prison. Durham will be sentenced Dec. 27.

His recognizance bond was continued.
