Man shot by police after firing at Clay Twp. officers indicted on charges

A man accused of exchanging gunfire with police in Clay Twp. in November will face criminal charges.

Aaron Mitchell, 40, of Brookville, was indicted Thursday by a Montgomery County grand jury on two counts of felonious assault on a police officer, two counts of failure to comply, and one count of discharging a firearm on or near prohibited premises, according to the Montgomery County Prosecutor’s Office.

Mitchell is accused of firing 10 shots at the Clay Twp. Administrative Building, which houses the Clay Twp. Police Department, on Arlington Road Nov. 30.

Mitchell drove away from the scene, leading multiple officers from several jurisdictions on a pursuit that ended on South Diamond Mill Road after the car ran over a tire-deflating device, officials said.

He was shot three times by officers after he pointed a gun at them when the pursuit ended, the prosecutor’s office said.

Mitchell remains booked in the Montgomery County Jail on a $150,000 bond. He will be arraigned on the charges Dec. 18.

Three police officers, including two from Clay Twp. and one from Brookville, were placed on paid leave for their involvement in the police shooting.

Brookville police Maj. Tom Simon is the officer on leave after his department said he fired his service weapon at the end of the pursuit. The two Clay Twp. officers were Sgt. James Hawkins and officer Jim Corcoran.
