A jury convicted Smith in January of aggravated vehicular homicide, aggravated vehicular assault and operating a vehicle while under the influence of alcohol.

The August 2016 crash on Hussey Road killed 68-year-old Raymond Deyo and seriously injured his wife, Linda Deyo, who was a passenger. Smith also suffered serious injuries.

Court records show Smith’s blood-alcohol content was .343, more than four times the state’s legal limit of .08.
