Virginia man, 19, who pleaded guilty to sexually assaulting 14-year-old girl won't go to jail

A 19-year-old Virginia man who pleaded guilty to tying up and sexually assaulting a 14-year-old girl will not serve active prison time, a Chesterfield County judge ruled Wednesday.

On Sept. 11, 2017, Logan Michael Osborn pleaded guilty to a charge of having carnal knowledge with the girl, WTVR reported. On Jan. 4, he was sentenced to 10 years in prison, with eight years suspended, The Richmond Times-Dispatch reported.

On Wednesday, Chesterfield Circuit Judge T.J. Hauler, noting that discretionary state sentencing guidelines called for probation instead of incarceration, the Times-Dispatch reported. In January, Hauler said he wanted more time to review the case and delayed sentencing for six months, the newspaper reported.

According to prosecutors, Osborn sexually assaulted the girl after they attended a school play together, tying a belt around her neck and hands, WTVR reported.

"The family (of the victim) is disappointed that the defendant will not serve any active incarceration for the brutal attack on the victim," Chesterfield prosecutor Erin Barr said on behalf of the family, the Times-Dispatch reported. "They do not believe justice has been served and shared concern for community safety and future potential victims."
