Ohio Supreme Court sets aside death sentence

The court found that Herring's attorneys failed to complete an adequate investigation into Herring's background to determine which mitigating factors should be presented to the jury during the death penalty phase of his trial.

In the early morning hours of April 30, 1996, Herring and five others stormed a Youngstown bar with their faces covered, demanding money and shooting four patrons and the bar owner. Three customers died.
