Ohio Supreme Court sets aside death sentence

The Ohio Supreme Court on Wednesday set aside the death sentence of a man convicted in a 1996 triple murder and attempted murder of two others during a robbery at a bar.

In a 4-3 ruling, the court sent inmate Willie Herring's case back to the Mahoning County Common Pleas Court for a new re-sentencing hearing with a new jury that will decide whether he should receive life in prison or the death penalty.

The court found that Herring's attorneys failed to complete an adequate investigation into Herring's background to determine which mitigating factors should be presented to the jury during the death penalty phase of his trial.

In the early morning hours of April 30, 1996, Herring and five others stormed a Youngstown bar with their faces covered, demanding money and shooting four patrons and the bar owner. Three customers died.
