Dayton man reindicted for head-on crash while dodging tire deflation devices during pursuit

A Dayton man has been reindicted on charges connected to a June crash where, while fleeing from police, he allegedly hit another driver head-on when he tried to avoid tire deflation devices.

Mateen Zahir Harvey, 28, was reindicted Friday in Montgomery County Common Pleas Court on one count of vehicular assault. He was previously indicted July 11 on one count of failure to comply with the order or signal of a police officer. Both charges are felonies.

He is free on a $10,000 bond, and is scheduled to be arraigned Aug. 30 on the vehicular assault charge.

The charges stem from a police pursuit that ended just after midnight on the morning of June 10, according to a Dayton Police Department crash report.

The crash report said that Harvey was driving a black 2018 Nissan Maxima south on North Main Street near Mary Avenue at 74 mph when he crossed the center lines to try to avoid two sets of Stop Sticks that had been deployed by police.

When he did so, he crashed head-on into an oncoming bronze 2009 Chevrolet Malibu, though the driver of the Malibu, a 53-year-old woman swerved to try to avoid him.

Harvey and the driver of the Malibu suffered serious injuries, the crash report said, and medics took both to Miami Valley Hospital.

The report said that Harvey did not have a valid driver’s license at the time of the crash.
