Man accused of shooting at neighbors over fireworks dispute indicted

A Dayton man arrested at his home earlier this month after a SWAT standoff is accused of firing shots at his neighbors who had been setting off fireworks.

Jason Michael Toscano, 37, was indicted Thursday for three counts of felonious assault, each with three-year firearm specifications. He is no longer in the Montgomery County Jail and is scheduled to be arraigned July 30 in Montgomery County Common Pleas Court.

Toscano fired one round from a handgun at three men July 6 as they left the back of a neighboring home in the 100 block of Livingston Avenue in Dayton. No one was hurt, and no property was damaged, court records.

The three men told police they had been in an argument with Toscano earlier in the evening because they were launching fireworks in their backyard, according to reports.
