The defense team for Combs filed a motion last month asking that he be freed from the Shelby County Jail. In the motion, they say that Combs has been a “model prisoner” at the jail and would reside at his home on Ruskin Road — the same residence where detective Jorge Del Rio was killed — or at Combs’ mother’s house on Ballard Drive.

“Mr. Combs has an extensive, stable and supportive family unit here in the Dayton, Ohio area,” the memorandum in support of the motion says.
Combs is not suspected of pulling the trigger and killing Del Rio, rather he is accused of participating in the drug enterprise and being present during Del Rio’s death. Combs’ co-defendant Nathan Goddard is accused of shooting Del Rio in the face.
During the raid, prosecutors said kilograms of fentanyl and cocaine were recovered along with a large sum of cash and marijuana.

Prosecutors argued in their court filings that the judge should keep Combs in jail.
“He has presented insufficient evidence to disturb the magistrate’s decision, let alone overcome the rebuttable presumption that he poses a danger to the community and a risk of flight,” prosecutors said in court filings.
