Dayton sues to close nightclub

The City of Dayton is asking a judge to shut down a downtown nightclub claiming it has become a public nuisance.  The lawsuit claims that Hammerjax frequently overcrowds its establishment interfering with the public’s health, welfare and safety.  The lawsuit says cops have been called out 193 times since January of 2009 for a variety of incidents including fights, auto theft, drugs and sex crimes.  Dayton Police Chief Richard Biehl tells the Dayton Daily News, “We’ve had no cooperation from Hammerjax to prevent these kinds of problems.”  No date has been set for a hearing.
