The 42-year-old man was not identified, police said. Patrick Mukuria Njogu, 39, who suffered a broken leg in the crash, was driving the wrong way on the Westpark Tollway at 11:30 p.m. when he hit the car carrying the man and two Harris County deputies, KPRC reported.

One deputy suffered a broken foot, numerous bruises and cuts, while the other deputy suffered a concussion, KTRK reported.

Njogu was charged with felony murder and intoxication assault on a peace officer, the television station reported.

"It wasn't like a wrong turn," Sean Teare, of the Harris County District Attorney's Office, told KPRC. "The information we have -- this guy was going for quite a while the wrong way on the Westpark Tollway before he hit these three people."

Authorities said Njogu's blood alcohol content was .23, nearly three times the legal limit in Texas.

Authorities also said Njogu has five DWI arrests and three convictions in Illinois and Missouri, KTRK reported.
