One brother arrested for OVI, the other for forgery

Two brothers were arrested earlier this month, one for driving while under the influence and the other for forgery.

A Fairfield Twp. police officer arrested 26-year-old Julio Cesar Perez Cruz around 1 a.m. Oct. 7 on suspicion of operating a vehicle while impaired at Buster’s Bar on Tylersville Road. The officer activated his overhead lights just prior to the intersection of Tylersville Road and Gateway Avenue, but the driver did not stop the vehicle until he pulled into the bar’s parking lot and into a parking space.

The officer, who had previous contact with Perez Cruz, knew he didn’t have a valid driver’s license and said he “had a very strong odor of an alcoholic beverage.” Perez Cruz declined to participate in a field sobriety test.

Perez Cruz’s brother, 24-year-old Luiz Miguel Perez Cruz, was also in the vehicle. He had a Social Security card and Ohio identification card, and police report the Social Security number “belonged to other people,” and the younger brother was arrested for forgery.

Police found three bottles of beer in the vehicle — one of which was open — and were under the passenger’s seat. Police could not verify the identities of the brothers. According to the report, the officer used a fingerprint scanner and no results were returned.

Julio Cesar Perez Cruz was transported directly to the Butler County Jail and declined to take a blood-alcohol content breath test and arrested for OVI, as well as for not having a valid driver’s license. Luiz Miguel Perez Cruz was processed at the Fairfield Twp. Police Department before being transported to the county jail on the forgery charge.
