Mayberry allegedly was driving at a high rate of speed when he ran through a red light at U.S. 35 and Liscum Drive and struck another vehicle, driven by 24-year-old Samuel R. Lerch, of Spokane, Wash., according to the prosecutor’s office.
Lerch died as a result of injuries he sustained and his passenger, 25-year-old William E. Partridge, of Concord, N.C., was seriously injured.
Partridge continues to suffer significant trauma from the injuries he sustained and he will require extensive medical care for the rest of his life, Montgomery County Prosecutor Matt Heck said in a statement.
Mayberry is being held in the Butler County Jail. An initial court hearing has not been scheduled.
