Alleged drunk driver arraigned in Greene County fatal crash

Kathy Smith was arraigned in Greene County Common Pleas Court Friday where she pleaded not guilty.

The case has been set for a pre-trial hearing.

She previously posted bond and is not in police custody.

A Greene County grand jury has indicted the driver who allegedly drove drunk and caused a fatal head-on crash on Hussey Road in August.

Kathy J. Smith, 63, of Xenia, was indicted this week on charges of aggravated vehicular homicide, aggravated vehicular assault, and two counts of operating a vehicle under the influence of alcohol or other drugs.

Smith was arrested Tuesday and is expected to be arraigned “within the next week,” said Greene County Prosecutor Stephen Haller.

Greene County Common Pleas Court Judge Stephen A. Wolaver set Smith’s bond at $10,000.

“I’m sure there’s going to be some conditions on that bond, but we don’t know what those are yet,” Haller said.

The charges stem from an Aug. 27 crash that killed Raymond K. Deyo of Bowersville and seriously injured Deyo’s wife, Linda.

“The investigation itself took several months,” said Haller in explaining why the grand jury decision came seven months after the crash.

The Ohio State Highway Patrol reported last year that Smith’s blood alcohol level was .343, more than four times the legal limit of .08. when she allegedly caused the crash.

Deyo was driving his 2004 Toyota Tundra pickup truck east on Hussey Road in Caesar Creek Twp., Greene County, around 3:35 p.m. Aug. 27 when he was struck by a 2011 Chevrolet Cruze driven by Smith that veered into his path, according to the Ohio State Highway Patrol’s Xenia Post.

If convicted on the most serious charge, Smith could face up to eight years in prison.
