Fairborn schools employee facing sex charge resigns

Fairborn City Schools board members this week accepted the resignation of a man facing a criminal charge of sexual imposition after he unsuccessfully appealed the results of a district investigation, according to records obtained by this newspaper.

The school board held a special meeting Thursday night to consider and approve the resignation of Jeffrey L. Whited, 61, of Fairborn, according to Treasurer Nicole Marshall. His resignation is effective May 26.

Whited, the former in-school suspension supervisor at Fairborn High School, is criminally charged with sexual imposition, a third-degree misdemeanor, according to Fairborn Municipal Court records.

Court records indicate Whited is accused in a March 2 incident at the high school involving a female student during in-school suspension.

Whited’s attorney submitted a plea of not guilty on his behalf on April 8. He remains out on his own recognizance and has a court hearing June 27, according to Fairborn Municipal Court records.

Neither Whited, who had been on administrative leave, nor his attorney returned phone calls seeking comment Friday, nor did school district officials immediately reply to requests for interviews about this story.

This newspaper used Ohio public records law to obtain Whited’s personnel file.

A review of those records shows the district’s grievance officer recommended Whited’s employment be terminated for just cause. The grievance officer found Whited violated board policy by friending students on Facebook and “engaging in sexual harassment” of a female student.

Whited appealed the findings in a letter to acting superintendent Ed Gibbons.

“At no time have I ever engaged in behavior which would constitute sexual harassment,” Whited wrote. “At no time did I engage in conduct which would constitute unwelcome sexual advances, request for sexual favors or other verbal or physical conduct of a sexual nature.”

According to court documents, Whited is accused of giving a female student a letter in the hallway, recommending an out-of-school suspension, but on the other side of the note writing, “Gotcha.” Then they hugged and he reportedly placed his hands on the sides of her breasts, those documents show.

Additionally, a Fairborn police report says Whited hugged another student and placed his hands on the sides of her breasts. He’s also accused of grabbing the student’s waist.

A third female student told police she would get hugged four to five times a day by Whited as she passed his classroom. He would grab her hand and pull her in, according to court records. The student said it happened so often she started taking a different route to get to her classes.

Whited is the former co-president of the Fairborn Education Association. According to district records, his 2015-16 salary was $14,488.
