Prosecutors want Miami County rape suspect back in jail

A judge has ruled that a rape suspect out of jail on a medical leave is competent to stand trial and prosecutors want him back in jail.

Gary W. Grubb, 52, formerly of Bethel Twp., Miami County, was found competent to stand trial Wednesday, Jan. 4, on a felony indictment accusing him of rape of a person under age 13.

Grubb, whose address now is listed as Xenia, was found competent by Judge Jeannine Pratt in Miami County Common Pleas Court. He is accused of sexual contact with a person under age 13 between September and December 2011 and has pleaded not guilty. A trial is scheduled in March.

Pratt said an evaluation at the Forensic Psychiatric Center of Ohio found Grubb was both competent at the time of the offense and competent to stand trial.

On Wednesday, Paul Watkins, assistant Miami County prosecutor, asked for Grubb’s return to jail on a $450,000 bond set after his arrest saying Grubb drove to court.

Pratt said she would consider lawyers’ motions regarding the bond once prosecutors were able to review Grubb’s latest medical records, which he agreed to release.

Defense lawyer Michael Brush, Pratt and Watkins discussed the status of Grubb’s medical condition. He is on a medical furlough from the county jail because of medical needs, surgery and the inability of the jail to accommodate his needs for a special bed and other care. He was released by Pratt last fall with several conditions including residing with his mother in Xenia and having no contact with the alleged victim or other children.
