Convicted Sex Offender Was Driving Ice Cream Truck

Authorities said a convicted sex offender is in jail for failing to register.

The suspect is now charged with a felony count of failure to notify because sex offenders are required by law to register both where they live and where they work.

Deputies arrested Jason Ivory Wednesday afternoon.

Montgomery County Sheriff Phil Plummer said, "Jason is a sexual predator."

Jason Ivory was doing a job you would not expect a convicted sexual offender to be hired to do.

"He was working on an ice cream truck going around selling ice cream to children," said Sheriff Plummer.

Plummer said Ivory lives in Dayton but sold ice cream in Fairborn neighborhoods.

A tip lead detectives to find Ivory, who never registered his job with authorities as required by law.

Sheriff Plummer said, "They know they have to notify us."

It is not illegal for a convicted sex offender to work with children, but had Ivory registered his position, officials would have made sure his boss knew about his criminal history.

In Ivory's case, it was a 2006 charge of gross sexual imposition involving an 8-year-old girl.

On Wednesday afternoon, all the doors were locked at Rochelle Wholesale in Harrison Township

Neighbor Brian Collett said the owner of the company is a good man. "He's been running background checks or trying to, yes."

However, Collett does not like the idea of a sexual predator working next door. "I don't like it because I have children," said Collett.

An employee of Rochelle Wholesale came outside and said the business does perform background checks, although the owner was still not available for an interview.

If convicted on the failure to notify charge, Jason Ivory could face three years inn prison.
