No charges in lighter-fluid dousing case

The criminal case has been dropped against a 46-year-old Fairborn woman accused of pouring gasoline on a woman and attempting to set her on fire in October 2013 at a Martha Avenue home.

Court records indicate that a Montgomery County grand jury returned a no bill Wednesday on the case against Kimberly Bennington. The charges — aggravated burglary, attempted aggravated arson, felonious assault and tampering with evidence — were cleared Wednesday, according to online records at the Montgomery County Jail.

Bennington had been accused of entering a woman's home on Oct. 6, 2013, pouring gas on the woman and then trying to ignite the fuel, according to documents filed in Kettering Municipal Court.

Officers located a gas can, a lighter and a container of lighter fluid, court records show.

According to police, the women know each other. Days after the incident in early October, Centerville police said the woman told them said awakened Oct. 6 to find Bennington in her bedroom. There was a struggle and at some point she was doused with lighter fluid and Bennington left.
