Dayton man admits role in Miami County overdose death

Quincy Mattison, 29, made the pleas in county Common Pleas Court. Another man previously pleaded guilty in to his role in the case.

As part of Mattison’s plea deal, prosecutors amended an involuntary manslaughter indictment to attempted involuntary manslaughter, a second-degree felony, and agreed to recommend a sentencing cap of three years.

Judge Christopher Gee found Mattison guilty, ordered a pre-sentence investigation and set sentencing for Aug. 27.

The charges stem from the Feb. 24, 2017, death of James Lennon, 33. Sheriff’s deputies said they responded to his home north of Troy and found him not breathing. A woman at the residence also overdosed but survived.

Also charged in the death was former West Milton resident Derek T. Gardner, 33, now of Sidney. He earlier pleaded to charges of attempted corrupting of another with drugs, a third-degree felony, and one count of aggravated trafficking in drugs.

Gardner’s sentencing is scheduled July 23.
