According to Franklin Municipal Court records, McIntosh, 41, was charged with operating a vehicle under the influence Sept. 3 by a trooper with the Ohio State Highway Patrol.
McIntosh was given a Breathalyzer test at the Franklin Police Department and recorded a blood-alcohol content level of 0.204, which is nearly three times the legal limit of 0.08.
At that time, McIntosh also received an administrative license suspension.
Judge Rupert Ruppert did not suspend McIntosh’s driver license, but did sentence McIntosh to a suspended 30-day jail term and he was required to complete the driver intervention program. McIntosh also was fined $250 and court costs. A marked lanes violation was dismissed.
Sims said McIntosh was placed on paid administrative leave Sept. 3 pending the completion of the court case and the internal investigation.
“The internal investigation concluded that his off-duty activity warranted termination,” Sims said. “We’re awaiting union action on the grievance process.”
McIntosh was appointed as a full-time deputy in January 2005. He also served as a special deputy from October 2004 to January 2005. McIntosh worked in court services as well as in the road patrol during his tenure as a deputy sheriff.
His past three evaluations noted that he met expectations. McIntosh also received a commendation in January 2009 for assisting Lebanon police during an armed robbery incident as well as for his actions in January 2008 for assisting a Morrow man in putting out a fire in his home.
McIntosh received a one-day unpaid suspension in June 2008 for failure to report for duty as scheduled. He received a 10-day unpaid suspension in October 2009 for absenteeism in July. The Warren County Deputy Sheriff’s Benevolent Association filed a grievance on McIntosh’s behalf and the discipline was modified in a settlement agreement to reduce the unpaid suspension to five days as McIntosh had already served the suspension. He received back pay and benefits for the five days that was previously served.
