Matthew Daniels was indicted Tuesday for improperly discharging a firearm into a habitation, plus a three-year firearm specification, stemming from an incident around 4:30 a.m. Aug. 12 at an apartment building in the 700 block of Summit Square Avenue, according to a Montgomery County grand jury report and court documents.
The woman and her grandchildren blocked the door and huddled on the floor after the shots were fired. Police found bullet holes in the kitchen and damage to a rear sliding door, and nine bullet casings, a Dayton police report stated. No one was hurt.
Daniels also faces a misdemeanor aggravated menacing charge for reportedly threatening to shoot up the residence the day before, according to the Dayton police report. He remains held in the Montgomery County Jail.

A woman and her grandchildren were sleeping in an upstairs apartment when shots were fired in the early morning hours into an apartment in the 700 block of Summit Square Avenue, according to a Dayton police report.
No one was injured but an apartment was damaged. Police responded shortly before 4:30 a.m. and found damage to a rear sliding door, bullet holes in the kitchen and nine 9mm bullet casings, the report stated.
The grandmother told officers that when she heard the gunfire, she gathered up her grandchildren, barricaded the front door and had everyone lay down on the floor. The grandmother told officers the apartment belongs to her granddaughter, who was not home. The woman’s daughter reported a man had threatened to “shoot up her house” the previous day, and an aggravated menacing police report was filed about it, according to the report.
Police said one witness also heard the gunfire and reported seeing a gold or tan sport-utility vehicle speed away from the scene.
