Miamisburg woman pleads in aggravated vehicular assault

A Miamisburg woman pleaded no contest Monday to three felonies of aggravated vehicular assault and a misdemeanor of operating a motor vehicle while under the influence in a traffic crash almost a year ago on Interstate 75 in southern Miami County.

Michelle Day, 38, was found guilty of all charges by Judge Christopher Gee in Miami County Common Pleas Court. Day was accused of causing the May 21, 2015, wreck in which three men were injured seriously.

She faces up to 15 ½ years in prison at sentencing set for June 13.

Defense lawyer Steve Layman said Day’s plea was part of a plea deal in which prosecutors agreed to recommend sentences on two of the felonies run concurrently while consecutive to the third felony count.

Day had been jailed since early March when her bond was revoked after she failed to appear for a court pretrial conference. She was released Monday on a recognizance bond pending sentencing. The bond included several conditions.
