Tipp City man found guilty in home invasion

TROY - One of two men accused of breaking into a Tipp City residence and assaulting and restraining a resident with duct tape before stealing guns and a vehicle pleaded no contest Monday to 11 felony charges in a Miami County court.

Shay Wooley, 49, of Tipp City, was arrested along with Carl E. Davis, 55, also of Tipp City, in the Nov. 26 home invasion. They were later indicted on one count of kidnapping, one count of grand theft of a motor vehicle, six counts of grand theft of a firearm, one count of aggravated burglary with a gun specification, one count of aggravated robbery and one count of felonious assault.

Wooley on Monday was found guilty after pleading no contest as charged. A pre-sentence investigation was ordered and sentencing scheduled for March 26.

A change of plea hearing for Davis is scheduled for later this week, according to court schedules.

Tipp City police reports said the home’s occupant reported he was alone when two men entered the residence. He said he was hit in the head before being restrained by the men using duct tape on his arms and legs. Police arrived around 6 p.m. to find the man free but tape hanging from his wrist.

He said intruders stole guns from a gun safe and left with one of his vehicles.

The vehicle was located that evening by Dayton police on Main Street with three people inside. They were brought back to Tipp City for questioning before Davis and Wooley were charged and jailed.

The resident was taken to Grandview hospital for a medical check.

Police later charged Kimberly Fannin, 34, of Dayton, with complicity to kidnapping, complicity to aggravated burglary, complicity to aggravated robbery and two charges of complicity to theft. She is accused of knowing about the robbery plans. The charges against Fannin are pending in Common Pleas Court.
