Silverman was convicted of gross sexual imposition, but that conviction was later reversed by the Court of Appeals.
His wife Heather, pleaded guilty last year to murder and arson after setting a fire that killed their 4-year-old boy and 4-month old baby.
Heather Silverman is serving 30 years to life in prison.
