Local doctor’s office fights OSHA citations

WEST CARROLLTON — A local doctor’s office is contesting three citations, classified as serious and willful, issued by the Occupational Safety and Health Administration in July.

Clem Kirkland, M.D., Inc., also known as the Kirkland Family Practice, 5928 Springboro Pike, has been accused of eight violations, including not having engineering and/or work practice controls in place that would eliminate or minimize employees’ occupational exposure to potentially infectious materials.

“We are hoping to resolve the issues between ourselves and the company,” said Bill Wilkerson, spokesman for OSHA’s Cincinnati office.

Other alleged violations included:

• Failure to make containers for contaminated sharps materials easily accessible to personnel.

• Failure to make a medical evaluation or follow-up available for an employee who had received a needlestick in June.

• Failure of the medical clinic to ensure that the employees who declined the Hepatitis B vaccination sign a declination form.

Besides Dr. Kirkland, Montgomery County real estate records show that the building that houses the family practice is owned by doctors Jeanne Kirkland, Deepak Kumar and Surekha Kumar.

By law, a copy of the medical clinic’s citation and notification of penalty must be posted immediately in a prominent place at or near the clinic’s address.
