Rape charges dismissed in Dr. Wine case

St. Marys optometrist, Dr. Douglas Wine, currently serving 15 months in prison on a charge of gross sexual imposition will not be facing a second criminal trial next month.
Auglaize County Prosecutor Ed Pierce has dismissed the case telling reporters it is unlikely a conviction could be obtained based on available evidence.
Dr. Wine was facing two counts each of rape, sexual battery and gross sexual imposition allegedly against a child under the age of 13.
In late October of 2011 a jury in Auglaize County Common Pleas Court in Wapakoneta found Wine not guilty of rape as charged, but guilty of a lesser offense of gross sexual imposition of a woman then age 69 when the offense happened in 2009 in Wine's rural home.
If additional evidence in this second case would surface the prosecutor has the right bring back the charges.
In the meantime Wine is appealing his conviction in the first case.
