The Stuart man was surfing about 30 to 40 yards from the shoreline when he was bitten on the foot, Volusia County Beach Safety Ocean Rescue spokesperson Tamra Marris said.
The injury was minor and the surfer was able to get out of the water on his own. He was not taken to the hospital, Marris said.
Marris called it "a typical case of mistaken identity" and said that the surfer did not see the shark.
This is the first shark bite in Volusia County this year.
