Woodbury, 23, of Dayton, was the boyfriend of Miller’s sister and had been arguing with Miller when the incident occurred, the prosecutor’s office said. Miller was 17 at the time.
The prosecutor’s office successfully filed a request for Miller’s case to be sent to adult court, mainly because of the nature of the crime and Miller’s history with the juvenile court system.
Judge Nick Kuntz on May 21 found probable cause and sent Miller’s case to adult criminal court.
