Man Who Reportedly Tackled Judge Appears In Court

A Greenville-area man, charged with retaliation in connection with the assault of a judge, appeared in Darke County Common Pleas Court Friday morning.

Judge Jonathan Hein entered a plea of not guilty on behalf of Donald Garwood, age 37, since he was in court without an attorney. One will be appointed to represent him.

Garwood is accused of tackling Probate/Juvenile Court Judge Michael McClurg as the judge stepped from his bench and entered a lobby area Thursday afternoon.

Garwood was in court before Judge McClurg on a non-support case.

Officials said that as Garwood was about to be returned to the Darke County Jail, he questioned Judge Hein as to why he couldn't enter a guilty plea. "Why do I need a lawyer?" he said. "I know I'm guilty."

His bond was set at $25,000 in cash. Judge Hein would not allow him to plead guilty until he consults with his legal counsel.

Judge Hein said he would ask the Ohio Supreme Court to appoint a visiting judge to hear the case since he and Judge McClurg are friends.

Judge McClurg returned to work in his court, located in the Darke County Government Center, on Friday morning.

Mc Clurg was treated at Wayne Hospital in Greenville Thursday afternoon for a head laceration, bumps and bruises.

Garwood could face a maximum of five years in prison and as much as a $10,000 fine, if convicted as charged.
