Shooting Death Under Investigation

Dayton police said the city's latest shooting death a case of involuntary manslaughter and the shooter may have fired the shot to protect himself.

Officers said they were originally called the deadly shooting Friday morning the result of a twisted love triangle.

However, after questioning the suspect, he was not arrested. Officers said they are now calling it a case of involuntary manslaughter.

The shooting victim was identified as Troy Bray, 39, of Fairborn. Police said said he was shot at least once in the chest just after midnight Friday.

Investigators said the men were at home on North Garland Avenue helping a woman move when some type of argument started.

Officers will not say exactly what happened, but they said there may have been some provocation on the part of one or more of the people involved. That is why they are considering the possibility that the shooter fired to protect himself.

Sgt. Gary White said, "We may have an incident of self defense, but we're not calling it that. We're gathering information for prosecutors. This might be one of those cases that might have to go to the grand jury."

White said everyone involved is cooperating, though the case is still very much an open investigation. It will be up to prosecutors to decide if there was any criminal wrong-doing.
