Marshall, convicted of burglary in 2008, is under indictment in Warren County on charges of illegal processing of drug documents in connection with an incident in May.
Cady found with the new charge that there is probable cause that Marshall violated the terms of his probation in Butler County. She set a hearing for 10 a.m. July 14 before Judge Michael Sage.
Marshall is slated to be arraigned on the fifth-degree felony at 8:30 a.m. July 2 in Warren County Common Pleas Court. He allegedly altered a prescription for Tylenol III at a Mason pharmacy in May, according to the Warren County Prosecutor’s Office.
In May 2008, the Mason High School graduate, who anticipated playing as an offensive lineman for the RedHawks, had twice entered a woman’s room at a Miami dormitory. On the second entry into the woman’s dorm room, Marshall flopped down on top of her and placed a pillow over her face before leaving the room after the two struggled.
Marshall said he had been binge drinking at an Oxford bar and at a friend’s house, and had wandered into the wrong room by mistake.
He was convicted of burglary in October 2008 following a three-day jury trial. He was sentenced to 60 days in jail, with credit for serving 36 days in jail, 120 days house arrest and 200 hours of community service, He also was ordered to attend drug and alcohol treatment and placed on one year of supervised probation and four years general probation.
