Dayton man accused of child sex crimes facing additional charges

A 51-year-old Dayton man previously indicted on child sex crimes is facing additional charges, including rape and attempted rape of child, according to the Montgomery County prosecutor’s office.

A grand jury indicted Gary Oscar Kelly on the following charges:

  • Five counts of rape of a child younger than 13
  • One count of rape by force
  • One count of attempted rape of a child younger than 13
  • Eight counts of gross sexual imposition of a child younger than 13
  • One count of public indecency

Kelly was indicted on two counts of gross sexual imposition of child younger than 13 on Dec. 7, which involved a 4-year-old victim, according to the prosecutor’s office.

As a result of that investigation, additional allegations of sex crimes involving children surfaced.

The new allegations involve a 6- and 13-year-old and occurred from January 1987 to August 1993.

“When law enforcement learns of allegations of sexual abuse, even when committed years or decades ago, we will prosecute those charges and hold the offender accountable,” said Prosecutor Mat Heck Jr. “Even though a disclosure is delayed, the victim still deserves justice.”

Kelly is currently out on bond and under house arrest. He is scheduled to arraigned on the additional charges April 15.
