He was indicted in July on two counts of rape involving a child under age 10, and one count each of gross sexual imposition and GSI of a child under age 13, according to Montgomery County court records.
The victims in the case are two girls, ages 7 and 10, according to Dayton police and the prosecutor’s office.
Smith is scheduled to appear for a pretrial hearing in December.
