Franklin man accused of violence at police station

LEBANON — A Franklin man who authorities said became combative and verbally abusive after being taken into custody for an alleged drunk driving incident has been indicted on misdemeanor charges.

John E. Lowther, 47, was indicted Friday by a Warren County grand jury for two counts aggravated menacing, both first-degree misdemeanors, and a single charge of criminal damaging, a second-degree misdemeanor. The grand jury declined to indict Lowther on a misdemeanor charge of vandalism. The indictments were made public on Tuesday.

Warren County Prosecutor David Fornshell said on Aug. 8, Lowther was taken to the Springboro police station for a Breathalyzer test for suspicion of drunk driving by Franklin police.

He said Lowther allegedly refused to exit the Franklin police cruiser when they arrived at the Springboro police station.

Fornshell said while police were reading the required documents before the test could be conducted to Lowther, he allegedly kicked the Franklin officer and became verbally abusive and threatened to kill him.

When Lowther was asked to use an electronic stylus and pad to sign his name that the information had been read to him, he allegedly used the stabbed the electronic pad repeatedly with the stylus, Fornshell said.

Lowther is being held in the Warren County Jail without bond. He is slated to be arraigned on the charges on Sept. 22 in Warren County Court.
