He is scheduled to be arraigned Tuesday in Montgomery County Common Pleas Court.

Kelly was arrested Nov. 29 by Dayton police on eastbound U.S. 35. He initially was booked into jail on suspicion of rape, gross sexual imposition and falsification charges, according to Montgomery County Jail records.
Now, he does not face any rape or falsification charges, records show.
His bond was set at $150,000 in Dayton Municipal Court.
