Man charged with using weapons while intoxicated

A Middletown man was charged by police with carrying a concealed weapon, using weapons while intoxicated and discharging a firearm within the city limits, according to a police report.

Danny Emerson, 64, was charged with the three misdemeanors Monday night in the 2100 block of South Breiel Boulevard, the report read.

When police arrived around 8:30 p.m., they were told Emerson was lying on the bench at the nearby picnic table. After Emerson refused to keep his hands up, an officer was able to place one handcuff on Emerson’s wrist, according to the report.

Police found a concealed firearm in the small of his back. Police also found three 40-ounce beer cans in the area.

Police said Emerson and another man were drinking beer by the picnic table when Emerson walked into the field and started firing his gun. Police collected evidence, including a Browning handgun and numerous prescription medications.

Police were unable to find any casings in the field where Emerson allegedly fired his gun, the report read.

Emerson will have his arraignment Wednesday morning in Middletown Municipal Court, according to records.
