Justin Coy Sherwood, 37, is scheduled to be arraigned Tuesday following his indictment filed Friday in Montgomery County Common Pleas Court.

A Cottage Avenue resident said he woke up out of a dead sleep Feb. 20 when he noticed someone was inside.

“I just immediately attacked him and was just trying to get him away from my son,” the resident said last month.

The suspect left his cellphone and glasses behind as he fled, and police later identified him as Sherwood.

He told police he entered the wrong home, but before he realized it he was pushed out by the resident.

Sherwood has been held in the Montgomery County Jail since his Feb. 22 arrest.
