Murder case suspect asks to withdraw plea

UPDATE @ 2:47 p.m. (Nov. 12):

A murder suspect, Michael Felton, who pleaded guilty to charges of murder, tampering with evidence and having weapons under disability earlier this month has asked to have his plea withdrawn, according to court records.

Felton had been scheduled for sentencing in the case this past Tuesday.

Court documents did not indicate if the court was going to accept the motion.

Felton is the suspect in the June fatal shooting of John Turner Jr., 44, of Dayton.

INITIAL REPORT:

Dayton resident Michael Antjuan Felton was found guilty Monday of fatally shooting another man in June, the Montgomery County Prosecutor announced in a press release.

Felton, 24, fatally shot John Turner Jr., 44, also of Dayton, during an altercation over a woman in a Norris Drive apartment complex parking lot on June 16, the release said. As the two were fighting, Felton produced a handgun and shot Turner in front of several people, including Turner’s child, who is a minor, the release said.

Felton was charged with felonious assault, tampering with evidence and having weapons while under disability. The last charged stems from a previous violation in which Felton was convicted of a violent burglary in 2012, and was barred from legally carrying a firearm as result.

He was also convicted of carrying a concealed weapon in 2010, officials said.

Felton is facing 15 years to life in prison. He’s scheduled to be sentenced on Nov. 10.
