Theft suspect loses shirts over Reese's Cups

A theft suspect at a BP station fought so hard to try to get away with two boxes of Reese's Cups he came out of both the shirts he was wearing when he walked in, police said.

Dayton police, in their incident report filed Tuesday, said 53-year-old Virgil Ellis was not only shirtless when they found him in the store in the 300 block of Salem Avenue on Monday afternoon, "he appeared to be very winded, tired and sweating from the struggle."

The man and woman working in the gas station/convenience store told police they recognized Ellis has having been in the business before. The male employee told police he saw Ellis take one box of peanut butter cups from a shelf and try to conceal it under his armpits, then take a second box, conceal it and walk toward the front of the store.

When the male worker confronted Ellis in one of the aisles, pushes were exchanged and the row was on, according to the incident report.

The fight moved to the back of the store, where several items were knocked from the shelves and onto the floor.

When the female employee blocked Ellis at another aisle, he grabbed her hair in an attempt to move her out of his path. According to the report, the woman defended herself by striking the suspect.

The scuffle was over by the time police arrived.

The two boxes of snack food, a total of 28 chocolate-covered peanut butter cups with each box valued at $45, were returned to the store, police said.

Ellis was taken first to Fifth District Headquarters to treat an abrasion and a cut to his hand, then to the Montgomery County Jail. Tuesday night, he remained there on a charge of felony unarmed robbery -- the use of or threatened use of force, according to online jail records. His bail is set at $10,000.
