Harris lived at 23 Birchwood Ave., where police say McKnight and her 4-year-old son Zaden likely were killed by suspect Antwan Anderson in the basement. McKnight's body was found April 11 near the banks of the Stillwater River. Police presume Zaden is dead, but they have not located his body. Anderson, 26, died of a self-inflicted gunshot wound April 7 during a shootout with Dayton police officers.
Montgomery County Prosecutor's Office spokesman Greg Flannagan said McKnight's homicide investigation is active and that Harris "has not been ruled out" of possibly facing other charges. Flannagan said he can't comment on the specifics of an ongoing investigation or her potential sentence.
Harris has been indicted for one count of theft, six counts of receiving stolen property and one count of misuse of credit cards belonging to McKnight. All are fifth-degree felonies. Court documents show Harris used stolen credit cards at three Walmart stores, two Walgreens stores and two banks.
Langer ruled that only the theft and misuse of credit card counts would merge. The maximum sentence for each fifth-degree felony is one year in prison and a $2,500 fine. Judges can sentence probation for fifth-degree felonies.
Court officials said Harris' hearing — originally scheduled "to consider plea terms" — was still scheduled. Harris is free on bond, but is being electronically monitored. No trial date has been scheduled. Harris' attorney Anthony VanNoy did not return a message seeking comment.
VanNoy argued in court documents that all of the receiving stolen property counts should merge for a total maximum sentence of one year on those counts and also merge with the theft count for a maximum of two years total.
In his ruling, Langer said he was persuaded by the prosecutors' memorandum and that each of the receiving stolen property counts "entails separate conduct."
McKnight's mother, Michelle Williams, did not return a message seeking comment.
