Court allows Xenia tax issue to remain on ballot

XENIA — A Greene County Common Pleas judge has dismissed a lawsuit filed against the city of Xenia seeking to remove the income tax issue off the May ballot.

The decision will allow Xenia’s to keep Issue 7 — which seeks a 0.5 percent income tax increase — on the May 4 ballot.

“We are very pleased,” City Manager Jim Percival said Friday, April 16. “The city of Xenia is committed to improving outreach to residents. It is now and always has been the city’s desire to make every attempt to continue to provide the level of services that our citizens have become accustomed to, and if passed, Issue 7 will do just that.”

The suit was brought by Virgil Vaduva, a Republican Tea Party-affiliated primary candidate, who is challenging Alan Anderson for a spot on the Greene County Commission.

Vaduva filed the civil lawsuit March 2, alleging the seven-member Council and Percival acted fraudulently and misappropriated funds as they prepared to place a 0.5 percent income tax increase before voters next month.

In particular, Vaduva said Xenia officials should not have used tax dollars to hire Columbus-based Avakian Consulting or pay $4,000 to Wright State for a survey on the subject.

Vaduva could not be reached for comment.
