Dayton man's accomplice in 1995 murder will complete his sentence

RICHMOND, Va. -- The accomplice of a Dayton man convicted in a 1995 murder has had his appeal rejected by the Virginia Supreme Court.  Billy Joe Brown of Dayton is serving a 72 year sentence for the murder of 21 year old Jennifer Evans, a student at Emory University.  The murder happened at a Virginia Beach nightclub in 1995.  Dustin Turner of Bloomington Indiana was also convicted in the crime and sentenced to 82 years.  Brown claimed in sworn affidavits that he alone strangled Evans, so Turner filed an innocence claim.  Brown says now that Turner's only involvement was helping him get rid of Evans' body.  Turner appealed to a state appeals panel that ruled that he should be exonerated.  But the full appeals court overturned the panel's decision.  Turner then appealed to the Virginia Supreme Court which has refused to exonerate Turner.
