Newman has a final pretrial hearing Aug. 29 at Fairborn Municipal Court on charges of failure to control and operating a vehicle while under the influence of alcohol, according to court records.
Newman, Wright State University’s former associate athletics director who has won Edinboro University’s president’s award for excellence in service, pleaded not guilty at his initial court appearance. Messages seeking comment from Newman or his attorney were not returned.
The arresting officer’s report said Newman staggered and almost fell, had “bloodshot, glassy eyes” and that Newman stated he knew the Beavercreek police chief well.
The report said Newman told the officer he was driving from his downtown office in Fairborn. Twice more in the report, Newman mentioned wanting to talk to the police chief.
A witness told police he saw Newman’s car cross over double yellow lines several times, and that it nearly hit a motorcyclist on New Germany-Trebein Road.
The report said Newman initially denied drinking alcohol, but later he stated he had two vodka and cranberry drinks. Newman refused to submit to a Breathalyzer test.
Newman attempted to perform some field sobriety checks. The officer wrote Newman did not correctly complete or follow directions in the gaze test or the walk-the-line test and that the one-leg test was stopped “for Newman’s safety.”
Court filings on Monday noted Newman received a driving permit to go with a revised work schedule.
