Settlement reached in Kimpel case in Shelby Co.

A former Shelby County sheriff's deputy has settled a lawsuit with the county against former Sheriff Dean Kimpel, but within days Jodi Van Fossen became the subject of another lawsuit.

Authorities said in both cases, county taxpayers are going to foot the bill.

In one lawsuit, Van Fossen will be paid $105,000, while in the other, she may be ordered to pay thousands.

Gwen Vanderlaan with Citizens for Accountability said, "The taxpayers are totally being fleeced in Shelby County."

Some members of the community said the continuing fallout from former Sheriff Dean Kimpel is weighing on them.

Recently, attorneys for the county settled a lawsuit filed by Van Fossen, a former deputy, against Kimpel and the county. Van Fossen claimed Kimpel created a hostile environment and physically assaulted her.

The county agreed to pay the $105,000 settlement that will be covered by the county's insurance.

However, within days of the first settlement agreement, the owner of a  Shelby County bar sued Van Fossen for alleged actions while she was a deputy, authorities said.

The new lawsuit alleged that Van Fossen made false and defamatory statements accusing the bar, The Fault Line, of engaging in drug activity.

The county is now defending Van Fossen in that lawsuit, and insurance would have to pay if she is found to be negligent.

Kimpel faces criminal counts of sexual battery and misuse of equipment. He remains on paid leave while the criminal case against him moves forward. He is expected in court next spring.
