“That’s what escalated the situation,” said McKinney.
The person who officers saw holding the rifle matched the description of the subject of the warrant, McKinney said, but officers could not confirm that was the subject.
Because the officers saw someone with a rifle, they stood by and consulted with the prosecutor’s office and the police chief.
“The decision was made not to get a search warrant at that time and to look for the subject with a warrant,” said McKinney. “Since it was a nonviolent misdemeanor, we did not pursue getting a search warrant and entering the house.”
Officers were able to make contact with people inside the home, who said the person officers were looking for was not there.
