The 25-page lawsuit seeks $75,000 in damages and accuses the above-mentioned of “malicious prosecution, abuse of process, false imprisonment, defamation and intentional infliction of emotional distress,” according to the lawsuit.
Mansour, who last week lost a bid to become one of the township’s next two trustees, says the department and township officials conspired against him before, during and after an internal investigation into how his 2007 case was handled.
Mansour was found not guilty during a jury trial in June in Butler County Area III Court on a charge of making false alarms, a first-degree misdemeanor.
Following the verdict, West Chester Twp. Police Chief Erik Niehaus said an internal investigation into probable cause — more of a review rather than a written report — found no wrongdoing on behalf of his department. His comment appeared in The Pulse-Journal in June.
Last month, Mansour decried Niehaus’ comments, saying a request of that investigation turned up nil. He has appeared several times since June during public meetings before trustees to talk about his case and other related matters.
Three days prior to filing the lawsuit, Mansour writes, he informed the trustees “of a Police cover up as a result of Defendant Eric Niehaus false representations (sic).”
During that same appearance Oct. 27, Mansour requested trustees launch an investigation of their own, and hire his company to conduct the investigation.
Township Administrator Judi Boyko confirmed Monday her office had received the lawsuit, and that it will “handle the complaint as they do all litigation.” She declined to comment further.
Mansour claims the actions of the township and its police department caused him “serious injury, psychological injury, emotional distress, great humiliation” and damage to his business, according to the lawsuit, which requests a jury trial.
